This Selency privacy policy (hereinafter the “Privacy Policy”) governs the relationship between:

The User (as defined in Article 1 below),
AND
BROCANTE LAB, a simplified joint-stock company (SAS) with share capital of €115,159, registered with the Paris Trade and Companies Register under number 801 558 875, whose registered office is located at 1 rue de Châteaudun, 75009 Paris, France.

Hereinafter collectively referred to as the “Parties” and individually as a “Party.”


Preamble

It has been previously stated that:

A. BROCANTE LAB develops and operates the Selency website available at:

B. The Site is an online marketplace connecting Sellers and Buyers for the sale of second-hand furniture and décor items.

C. BROCANTE LAB acts as a trusted third party facilitating transactions between Buyers and Sellers.

D. BROCANTE LAB is neither a Seller nor a Buyer and does not control transactions carried out on the Site; it shall not be held liable in this respect.

E. Sellers are solely responsible for:

  • the listings they publish,

  • the sale of items,

  • handling any Buyer complaints.

Buyers are solely responsible for their purchases and their actions on the Site.


Article 1 — Definitions

The following terms shall have the meanings set out below:

  1. Buyer: any User purchasing one or more Items on the Site.

  2. Listing: any offer to sell one or more Items published by a Seller.

  3. Item: any furniture or décor product offered for sale on the Site.

  4. Shop: all Items offered for sale by a Seller.

  5. Ranking: the relative priority given to certain Listings on the Site.

  6. Order: the process of purchasing an Item on the Site.

  7. Commission: the amount received by BROCANTE LAB for a sale made on the Site.

  8. Content: any content posted by a User (photos, messages, etc.).

  9. Delivery by Selency: delivery service organized by BROCANTE LAB.

  10. Item Price: price paid by the Buyer excluding delivery fees.

  11. Transaction Price: Item Price plus delivery fees.

  12. Profile: the personal page of a registered User.

  13. Private Messaging: messaging system available on the Site.

  14. Hand Delivery: optional in-person handover between Buyer and Seller.

  15. User: any person browsing the Site.

  16. Seller: any User offering Items for sale.

  17. Professional Seller: any Seller acting within a professional activity.


Article 2 — Purpose

This Privacy Policy defines how BROCANTE LAB processes Users’ personal data.


Article 3 — Personal Data Protection

3.1 Data collection

BROCANTE LAB places great importance on protecting personal data.

Data is collected in compliance with:

  • French Data Protection Act,

  • GDPR (EU Regulation 2016/679).

Data is collected directly from Users when:

  • creating an account,

  • creating a shop,

  • placing an order.

Mandatory fields are indicated with an asterisk.


3.2 Legal bases

Contract performance

Processing necessary to provide the Site and services.

Consent

For cookies and certain communications.

Legal obligation

Retention required by law.

Legitimate interest

Fraud prevention, security, service improvement.


3.3 Purposes of processing

Data is used to:

  • allow Site navigation,

  • manage orders (payment, delivery, invoicing),

  • enable item localization,

  • prevent fraud,

  • provide customer support,

  • improve the Site,

  • send transactional and promotional emails,

  • conduct satisfaction surveys,

  • produce internal analytics,

  • manage legal requests and disputes.


3.4 Categories of data

BROCANTE LAB may process:

  • name and contact details,

  • transaction history,

  • listings and content,

  • bank details necessary for payments.


3.5 Recipients

Data may be shared with:

  • Sellers,

  • payment providers,

  • delivery providers,

  • hosting provider (AWS),

  • legal authorities when required.

Transfers outside the EU are subject to appropriate safeguards.


3.6 Security

Data is stored in France.
BROCANTE LAB implements appropriate security measures.


3.7 User rights

Users have the right to:

  • access their data,

  • rectify data,

  • erase data,

  • restrict processing,

  • object to processing,

  • data portability,

  • withdraw consent,

  • define post-mortem instructions.

3.8 Retention periods

  • Customer data: 3 years after last contact

  • Analytics cookies: 13 months

  • Contracts and invoices: up to 10 years depending on legal obligations

Data may be archived longer in case of legal disputes or legal obligations.

BROCANTE LAB uses:

  • session cookies,

  • analytics cookies,

  • third-party cookies.

Consent is collected where required.
